Terms of Service

Please read these Terms of Service ("Terms") carefully before using VelocityKit ("the Service"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing and using VelocityKit, you accept and agree to be bound by these Terms, our Privacy Policy, and our License Agreement. If you do not agree, you may not use the Service.
2. Description of Service
VelocityKit is a production-ready SaaS starter kit providing source code, documentation, and development tools. The Service includes access to download the codebase, updates for the period specified in your purchase, documentation, and your account dashboard. We may modify, suspend, or discontinue any aspect of the Service, with reasonable notice of material changes where possible.
3. User Accounts
To access certain features you must create an account and agree to provide accurate information, keep your password secure, accept responsibility for activity under your account, and notify us of unauthorized use. We may terminate or suspend your account for violation of these Terms; you may delete your account at any time. Upon termination you retain rights to code already downloaded under the License Agreement.
4. Purchases and Payments
VelocityKit is available as a one-time purchase that includes a perpetual license to use the codebase (see License Agreement), 12 months of updates from the date of purchase, and access to download the latest version during your update period. When your update period ends you retain full rights to the version you have downloaded but no longer receive new updates unless you purchase an extension. Prices may change without affecting existing purchases. All sales are final once access has been provided — see our Refund Policy.
5. License and Intellectual Property
Your use of the VelocityKit codebase is governed by our License Agreement. The code is licensed, not sold; you may build unlimited commercial products but may not redistribute, resell, or share the source code, or create competing starter-kit products.
6. Acceptable Use
You agree not to violate laws, infringe others' rights, upload malicious code, gain unauthorized access, disrupt the Service, share account credentials, or circumvent security or license restrictions.
7. Your Content
You retain ownership of any content and products you create using VelocityKit. We claim no rights over your application code, data, or business.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, incorporated by reference.
9. Third-Party Services
VelocityKit integrates with third-party services (Supabase, Stripe, PostHog, Resend, Vercel, etc.). You are responsible for complying with their terms; we are not responsible for their content, policies, or practices.
10. Disclaimer of Warranties
THE SERVICE AND ALL CODE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. You are responsible for testing and validating the code for your use case.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VELOCITYKIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA. Our total liability shall not exceed the amount you paid us for your purchase.
12. Indemnification
You agree to indemnify and hold harmless VelocityKit and its officers, directors, employees, and agents from claims arising out of your use of the Service or violation of these Terms.
13. Governing Law & Disputes
These Terms are governed by the laws of the jurisdiction in which VelocityKit operates. Disputes shall first be attempted informally by contacting support@velocitykit.dev; if unresolved within 30 days, either party may pursue resolution through the courts in that jurisdiction.
14. Changes to Terms
We may modify these Terms at any time, posting the update here, revising the "Last updated" date, and emailing account holders of material changes. Continued use constitutes acceptance.
15. Severability & Entire Agreement
If any provision is unenforceable, the remainder stays in effect. These Terms, together with our Privacy Policy, License Agreement, and Refund Policy, constitute the entire agreement regarding the Service.
